Default lowest temp setting beverage air

I have my kegerator in the garage and it't now about 80F in the garage. I noticed that the Bev Air kegerator was sitting at about 44F on it's coldest setting. I had a refrigerator tech come out and check out the kegerator. He spoke little English (not much help to me) but mostly Russian. Anyway, he was a friendly guy and said that my coil condenser was really dirty. He cleaned it and also said that my system was over charged with freon.

When he left the kegerator is still in the coldest position and is cooling to 37 - 38F nicely. The compressor shuts off as well so to me it seems that the cooler is happy when it reaches that temperature. When the compressor kicks on again I noticed that my liquid temp is around 39F. Fairly stable temp, but just wondering if my temp control (thermostat) is out of line. Shouldn't I be able to get this Bev Air unit colder than 37F if I wanted?
